Financial Power of Attorney
A financial power of attorney is a simple but legally sound way of permitting someone to manage your finances in the event that you are unable to make decisions for yourself. It can be drafted so that is goes into effect immediately or you can manage the timing of it so that it can only come into effect with a doctor’s certification.
If you are unable to handle financial decisions for a temporary period, this document will give your agent broad authority to step in and manage financial decisions for you. Using the financial power of attorney, your agent will have access to your bank, investment, and retirement accounts immediately in order to pay pills and handle all necessary transactions. Your agent is required to act in your interest at all times and to maintain accurate records of all decisions.
The financial power of attorney gives the agent the right to maintain any real estate you own, collect Medicare, Social Security or other benefits, file/pay your taxes, operate your small business, create a trust, make gifts to your family members, and hire attorneys, accountants or other professionals needed to represent you.
Without a valid power of attorney, your family will need to file court action for conservatorship of your assets. This action is costly and time consuming and requires your conservator to file periodic reports with the court on an ongoing basis. Creating a simple power of attorney will allow you to choose who will become your agent and will save your family money and stress.
